Welcome to Spenzaa. These Terms and Conditions ("Terms") govern your access to and use of the Spenzaa mobile applications, web dashboard and website (collectively, the "Service") operated by Spenzaa Inc. ("Spenzaa", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@spenzaa.com if you suspect unauthorized access.
2. The Service
Spenzaa provides AI-powered expense tracking, categorization, budgeting and financial insight tools. The Service is provided for personal informational purposes only. Spenzaa is not a bank, financial institution, investment adviser or tax adviser, and nothing in the Service constitutes financial, investment, legal or tax advice. You should consult a qualified professional before making financial decisions.
3. AI-Generated Insights
Insights, forecasts, categorizations and recommendations are generated by machine-learning models based on your data. While we strive for accuracy, AI outputs may contain errors or omissions. You acknowledge that:
- Forecasts are estimates, not guarantees of future outcomes;
- Automatic categorizations may occasionally be incorrect and should be reviewed;
- You remain solely responsible for your financial decisions.
4. Subscriptions & Payments
The core Service is free. Optional paid plans ("Spenzaa Pro") are billed in advance on a monthly or annual basis through your app store account and renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your app store settings. Fees are non-refundable except where required by law or by the applicable app store's policy.
5. Your Data & License to Us
You retain ownership of the data you provide. You grant Spenzaa a limited, revocable license to process your data solely to operate and improve the Service, as described in our Privacy Policy. We never sell your personal data to third parties.
6. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or in violation of any regulations;
- Reverse-engineer, scrape, or attempt to extract our models or source code;
- Interfere with the integrity or performance of the Service;
- Upload malicious code or attempt unauthorized access to other accounts;
- Resell or commercially exploit the Service without our written consent.
7. Intellectual Property
The Service, including its software, design, logos, AI models and content (excluding your data), is owned by Spenzaa Inc. and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the apps on your devices for personal use.
8. Third-Party Services
The Service may interoperate with third-party services (e.g., account aggregation providers, app stores). Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or completely secure.
10. Limitation of Liability
To the maximum extent permitted by law, Spenzaa shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, savings, data or goodwill, arising from your use of the Service. Our total aggregate liability shall not exceed the greater of (a) amounts you paid to Spenzaa in the 12 months preceding the claim, or (b) USD 50.
11. Termination
You may stop using the Service and delete your account at any time from the app settings. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases and your data will be deleted in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which Spenzaa Inc. is incorporated, without regard to conflict-of-law principles. Disputes shall first be attempted to be resolved informally by contacting us; failing that, they shall be submitted to the competent courts of that jurisdiction.
